Lumin Oasis reserves the right to modify these Terms and Conditions at any time, for any reason, and without prior notice. By purchasing our products or services you hear by agree to all of the following TOS. The most current version of these Terms and Conditions will be posted on this page.

Photography & Videography Terms of Service

Welcome to Lumin Oasis. By booking our photography and videography services, you agree to be bound by the following Terms of Service. Please read them carefully before securing your appointment.

 

1. Services & Booking Packages

Package Structure: Services are offered in predefined packages, each specifying a set number of photos, videos, edits, deliverables, and features (e.g., watermark removal or priority delivery). Packages are priced per session.

 

Additional Deliverables: To request more photos, videos, or edits than what is outlined in the selected package, clients must either:

Book an additional editing session.

Pay an additional per-item fee.

Upgrade to a Pro Monthly Plan (where applicable).

2. Security Deposit & Payment Schedule
Securing Your Booking: To reserve a specific date, time, and professional creator, a $100 non-refundable security deposit is required. This deposit ensures exclusive reservation of your time slot, serves as an advance partial payment toward your total balance, and protects against unnecessary bookings that impact other clients.

Remaining Balance: The remaining balance of the chosen package and any added services is due immediately upon session completion. Please note that final deliverables will not be released until full payment is processed.
 

3. Cancellations & Rescheduling Policy


A. Cancellation Policy

Notice Provided (24+ hours): Clients may cancel their reservation at least 24 hours prior to the scheduled start time. In such cases, any additional payments made beyond the security deposit will be refunded, less a 7% payment processing fee. The $100 security deposit remains non-refundable.

Late Cancellation (<24 hours): Any cancellation notice provided within 24 hours of the scheduled session is subject to an $80 late cancellation fee, which will be deducted from any funds paid beyond the security deposit.

B. Rescheduling Policy
Lumin Oasis understands that circumstances may change; however, professional time is a limited resource. To ensure availability for all clients, the following rules apply:

Rescheduling Allowance: Clients are permitted a maximum of two (2) rescheduling requests per original booking.

Fee Structure: Each rescheduling request, regardless of the notice provided, is subject to an $80 rescheduling fee, which must be paid prior to confirming a new date.

Third Request Threshold: Upon the submission of a third (3rd) rescheduling request, the current reservation will be automatically canceled. The $100 security deposit will be forfeited, and the client will be required to submit a new reservation request, including a new security deposit, for any future session.

C. Administrative Rescheduling
Lumin Oasis reserves the right to reschedule any booking due to unforeseen circumstances, equipment failure, or emergencies. In such instances, the client will be provided with priority scheduling options at no additional cost.

4. Refund Policy

In-Progress/Completed Work: No refunds will be issued once a project has commenced or has been completed.

 

Deposits: All reservation security deposits are strictly non-refundable.

 

5. Revisions

Revision Limits: Clients are entitled to a limited number of revision rounds per session, as dictated by their specific package details.

 

Major Revisions: Requests for major revisions that deviate substantially from the original creative vision or agreed-upon brief will incur additional labor fees.

 

6. Watermarks & Branding

Standard Watermarking: To protect our intellectual property, a digital watermark will be applied to all final deliverables unless the selected package explicitly includes a "Watermark Removal" feature.

 

Watermark Removal Fee: If a client wishes to have the watermark removed from their final deliverables and it is not included in their package, they may purchase watermark removal for a flat, additional fee of $100.

 

7. Turnaround Times & Urgent Requests

Standard Turnaround: Photography projects typically require 7–14 business days for editing and delivery. Videography projects typically require 7–30 business days for editing and delivery. Turnaround times may fluctuate based on project complexity.

 

Urgent Requests (Priority Delivery): If a client requires an accelerated turnaround time and their package does not explicitly include Priority Delivery, they may add this service.

 

Priority Delivery fees start at $100 and may increase depending on the complexity, scale, and required timeline of the project.

 

8. Location, Travel, & Studio Fees

External Site Fees: For sessions at locations requiring admission tickets, permits, passes, or venue subscriptions, the client is responsible for covering these additional costs.

 

Off-Site Travel Fees: For locations outside a 30-mile radius of the "Denver Tech Center" (DTC) in Greenwood Village, CO, an additional travel fee will be applied to cover expenses (including but not limited to fuel, mileage, flights, or train fare).

 

Studio Etiquette: When utilizing our studio spaces, clients are expected to respect the property. Littering, property damage, or loitering outside of scheduled session hours is strictly prohibited and may result in damage fees.

 

9. Platform & Processing Fees

Marketing Platform Fee: If a client initiates contact or submits an inquiry through a third-party marketplace that charges Lumin Oasis on a per-lead basis (e.g., Thumbtack, Bark, Fash), a marketing platform fee may be appended to the project total. This fee is waived for projects with a total budget exceeding $700.

 

Online Payment Processing Fee: A 5% online transaction fee will be applied to the total remaining balance if the payment (excluding the initial security deposit) is processed online.

 

10. Mandatory Release Documents

To ensure the lawful delivery and distribution of media, two release documents must be fully executed and returned to Lumin Oasis prior to the delivery of final files:

 

Photo/Media Usage Rights Form: Outlines the terms regarding the use of your media for Lumin Oasis’s professional portfolio and marketing platforms. Clients retain the option to grant or deny marketing permissions.

 

Session Agreement: Details the specific parameters of your session, finalized pricing, and relevant copyright protocols.

 

11. Copyright & Licensing

Personal Licenses: A non-commercial, personal-use license is granted with all standard sessions.

 

Commercial Licenses: A commercial license is required for any business, promotional, or monetization purposes. Commercial licensing can be acquired by booking a designated Commercial Package or purchasing a standalone commercial license (starting at $75/month).

 

If a package includes a commercial license, it remains valid for the duration specified in the package. Upon expiration, licenses must be renewed to avoid copyright infringement.

 

Online Attribution: For all digital, web, and social media postings (both personal and commercial), clients are required to credit Lumin Oasis by including a tag, handle, or direct hyperlink to luminoasis.com.

 

12. Governing Law & Modifications

Modifications: Lumin Oasis reserves the right to modify these Terms of Service, as well as service pricing, at any time without prior notice to accommodate business needs, market changes, or promotional events.

 

Governing Law: This policy, and all agreements therewith, shall be governed by and construed in accordance with the laws of the City and County of Denver, Colorado.

Editing Services Terms of Service

By submitting media to Lumin Oasis for standalone post-production and editing services, you agree to be bound by the following Terms of Service. Please review these terms carefully prior to initiating a project.

 

1. Scope of Services

Package Structure: Photo and video editing services are offered in structured packages, each defining a specific number of projects, deliverables, and included features (e.g., watermark removal or priority delivery timelines). Packages are priced per editing session.

 

Exceeding Package Limits: To request editing for more raw files, assets, or projects than what is explicitly included in your chosen package, clients must either:

Book an additional editing session.

Pay an additional per-asset editing fee.

Upgrade to an applicable Pro Monthly Plan.

 

2. Cancellations & Refund Policy

Eligible Cancellations: Cancellation and refund requests will only be honored for projects where editing work has not yet commenced. Eligible cancellations will receive a full refund, minus a 7% administrative processing fee.

 

In-Progress & Completed Work: Once digital assets have been transferred and editing work has begun or has been completed, the project is strictly non-refundable, and no cancellations will be permitted.

 

3. Revisions

Standard Revisions: Clients are entitled to a limited number of revision rounds per project, as dictated by the specific guidelines of their chosen editing package.

 

Major Revisions: Requests for major revisions—defined as significant changes that deviate from the original creative brief, project instructions, or initial vision—will incur additional hourly or flat labor charges.

 

4. Watermarks & Proofing

Proofing Watermarks: To protect our post-production labor, a digital watermark will be applied to all draft and final review deliverables unless the selected editing package explicitly includes a "Watermark Removal" feature.

 

Watermark Removal Fee: If a client wishes to receive the unwatermarked, high-resolution final files and it is not included in their package, they may purchase watermark removal for a flat, additional fee of $100.

 

5. Turnaround Times & Urgent Requests

Standard Delivery: Editing turnaround times vary depending on project scale and complexity. Estimated timelines will be provided upon project onboarding.

 

Urgent Requests (Priority Delivery): If a client requires an accelerated turnaround time that bypasses our standard editing queue, and their package does not explicitly include Priority Delivery, they may add this service.

 

Priority Delivery fees start at $100 and will scale upward based on the complexity of the media, the volume of assets, and the urgency of the deadline.

 

6. Intellectual Property & Copyright

Original Media Ownership: Clients retain full copyright and ownership of all original, raw source media submitted to Lumin Oasis.

 

Marketing Rights: Unless explicitly restricted via a prior written agreement, Lumin Oasis reserves the right to feature clips, before-and-after comparisons, or final edited projects within our professional portfolio, website, and marketing channels.

 

Online Attribution: For all online and social media distribution of the edited work, clients are requested to credit our post-production work by tagging or linking to luminoasis.com.

 

7. Service Disclaimers

Quality Standard: Lumin Oasis utilizes industry-standard software and professional expertise to deliver high-quality post-production services. However, the final output quality is heavily dependent on the quality, resolution, and lighting of the source files provided by the client. Lumin Oasis does not guarantee specific aesthetic outcomes beyond technical competency.

 

Limitation of Liability: Lumin Oasis is not liable for any direct, indirect, or consequential damages, profit losses, or data corruption resulting from the use, delivery, or delay of edited media.

 

8. Governing Law & Modifications

Modifications: Lumin Oasis reserves the right to modify these Editing Service Terms, as well as standalone editing rates, at any time without prior notice to reflect business adjustments or market demands.

 

Governing Law: This policy, and all editing service agreements therewith, shall be governed by and construed in accordance with the laws of the City and County of Denver, Colorado.

Editing Pro Plans Terms of Service

By subscribing to a Lumin Oasis photo or video Editing Pro Plan, you (the "Client") acknowledge and agree to the following recurring subscription terms and conditions.

 

1. Scope of Subscription Services

Plan Deliverables: Editing Pro Plans provide ongoing, monthly photo or video post-production services scoped strictly within the specific parameters, asset limits, and turnaround guidelines of your chosen tier.

 

Overage Policy: Media requests exceeding your monthly plan allocation will require either a temporary plan upgrade or will be billed separately as standalone editing sessions at standard rates.

 

2. Subscription Commitment & Billing Cycles

Initial Commitment: All Editing Pro Plans require a minimum one-month service commitment.

 

Recurring Billing: Subscriptions are billed automatically every month on a recurring cycle using the payment method on file.

 

3. Cancellation Policy

Eligibility: Subscription cancellations are eligible and will be fulfilled at any point after the initial one-month commitment has been met.

 

Notice Requirement: Cancellation requests must be submitted in writing via email to support@luminoasis.com at least 7 days prior to the next scheduled billing cycle date. Failure to provide 7 days' notice will result in the automatic processing of the next month's payment, and the subscription will instead terminate at the end of that subsequent cycle.

 

4. Refund Policy

Active Billing Cycles: No refunds, partial refunds, or pro-rated credits will be issued for any active or currently processing billing cycles.

 

Rendered Services: No refunds will be issued for in-progress or completed editing projects under any circumstances.

 

5. Revisions

Standard Plan Revisions: Clients are entitled to a set number of revision rounds per project, as explicitly outlined in their designated subscription tier.

 

Major Revisions: Structural changes that deviate fundamentally from the initial creative brief or project parameters provided during onboarding are not covered by the monthly allotment and may incur additional labor fees.

 

6. Watermarks & Subscription Perks

Watermark Protocols: Unless a specific Editing Pro Plan explicitly includes a "Complimentary Watermark Removal" feature as part of its monthly perks, a digital watermark will be applied to all project deliverables.

 

Watermark Removal Fee: Subscribers whose plans do not feature watermark removal may have the watermark permanently removed from a project for an additional flat fee of $100 per project.

 

7. Turnaround Times & Urgent Priority Requests

Standard Subscribed Queue: Projects submitted under a Pro Plan are subject to standard subscription queue turnaround times, which scale according to project complexity.

 

Urgent Requests (Priority Delivery Upgrade): If a subscriber requires a project to bypass the standard queue for accelerated delivery, and their plan tier does not explicitly include Priority Delivery, they may purchase it as an add-on.

 

Priority Delivery upgrades start at $100 per request and will scale upward based on the volume of media and the complexity of the deadline.

 

8. Intellectual Property, Portfolio Rights, & Attribution

Source Material Ownership: Clients retain full copyright and ownership of all raw footage, photographs, and assets submitted to Lumin Oasis.

 

Marketing & Portfolio Rights: Unless explicitly restricted via a prior signed non-disclosure agreement (NDA) or written contract, Lumin Oasis reserves the right to showcase edited projects (or before-and-after comparisons) within our professional portfolio, website, and marketing channels.

 

Online Attribution: For all public digital and social media distribution of media edited under our Pro Plans, clients are required to credit our post-production work by tagging our handles or providing a direct link to luminoasis.com.

 

9. Confidentiality

Non-Disclosure: Lumin Oasis values your proprietary data and will treat all client media, brand materials, and business information as strictly confidential.

 

Third-Party Protection: Lumin Oasis will not sell, disclose, or distribute any confidential client information or pre-released media to third parties without the client’s explicit prior written consent.

 

10. Service Disclaimers & Plan Adjustments

Pricing Adjustments: Lumin Oasis reserves the right to adjust monthly subscription pricing or alter service tier structures. In the event of pricing changes, active subscribers will be given written notice prior to their next billing cycle.

 

Limitation of Liability: Lumin Oasis is not liable for any direct, indirect, or incidental business losses, platform penalties, or project delays arising from the use or delivery of edited media.

 

11. Governing Law & Modifications

Modifications: Lumin Oasis reserves the right to modify this policy and terms of service at any time without prior notice. Continued subscription to a plan after changes are published constitutes agreement to the updated terms.

 

Governing Law: This policy, and all subscription agreements therewith, shall be governed by and construed in accordance with the laws of the City and County of Denver, Colorado.

Graphic Design Terms of Service

By commissioning graphic design or branding services from Lumin Oasis, you (the "Client") agree to be bound by the following Terms of Service. These Terms, alongside your specific Project Agreement, govern our creative partnership.

 

1. Scope of Services & Project Agreements

Creative Offerings: Lumin Oasis provides professional graphic design services, including but not limited to flyers, social media assets, logos, business cards, merchandise/apparel layouts, posters, menus, brochures, and marketing collateral.

 

Project Agreements: Each creative campaign requires a signed Project Agreement detailing the exact scope of work, asset deliverables, production timelines, and cost structures. If a conflict arises between these general Terms and a specific Project Agreement, the Project Agreement shall prevail.

 

2. Client Responsibilities & Asset Submission

Design Briefs & Copy: The Client is solely responsible for providing comprehensive creative briefs, accurate text/copy, and high-resolution brand assets (logos, images) necessary for project completion. Delays in asset submission will result in project timeline extensions.

 

Proofing Responsibilities: The Client is entirely responsible for proofreading all final text, layout designs, and dimensions prior to final approval. Lumin Oasis is not liable for errors (such as typographical mistakes, color shifts, or formatting issues) discovered after the client has greenlit a design for print or digital deployment.

 

3. Cancellations & Refund Policy

Official Project Start Time: Upon receiving all necessary client assets, Lumin Oasis will issue an onboarding email to the Client explicitly stating the scheduled Project Start Time.

 

Eligible Cancellations: To receive a refund of any package payments made, cancellation requests must be submitted in writing at least 24 hours prior to the scheduled Project Start Time. Eligible cancellations will be refunded minus the non-refundable project deposit and a 7% administrative processing fee.

 

Late Cancellations & In-Progress Work: No refunds or cancellations will be permitted within the 24-hour window leading up to the Project Start Time, nor will any refunds be issued for projects that are already in progress or completed.

 

Deposits: All initial project reservation deposits are strictly non-refundable under all circumstances.

 

4. Watermarks & Draft Deliverables

Draft Presentation: To safeguard intellectual property during the concept phase, all initial design drafts and visual proofs will be heavily watermarked or locked against unauthorized download.

 

Watermark Removal & High-Res Delivery: Upon project completion and receipt of full payment, final high-resolution, unwatermarked files will be delivered according to the selected package specifications. If a basic package does not include native, unwatermarked master file removal features, the client may purchase the removal of watermarks/delivery of unwatermarked project master files for a flat fee of $100.

 

5. Turnaround Times & Urgent Requests

Production Cadence: Production schedules are estimated individually within each Project Agreement based on complexity and queue volume.

 

Urgent Requests (Priority Delivery Upgrade): If a client requires an accelerated design turnaround (e.g., last-minute event flyers) and their package does not explicitly include Priority Delivery, they may add this service.

 

Priority Delivery upgrades start at $100 per asset/request and scale upward based on layout complexity, formatting requirements, and the imminence of the deadline.

 

6. Revisions & Scope Creep

Included Revisions: The number of standard revision rounds is strictly defined within the Project Agreement.

 

Excessive Revisions & Scope Creep: Revisions requested beyond the allocated limit, or requests that completely alter the foundational aesthetic direction agreed upon in the initial brief, will incur an additional labor fee billed at our standard hourly design rate.

 

7. Payment, Fees, & Suspension of Service

Payment Structures: Projects typically require a non-refundable upfront deposit prior to entering our design queue, with the balance due upon final proof approval.

 

Service Suspension: Lumin Oasis reserves the right to immediately freeze design production or withhold final asset delivery in the event of late payments or unverified payment processing.

 

8. Intellectual Property, Source Files, & Licensing

Copyright Transfer: Upon receipt of full and final payment, copyright ownership of the final, approved vector/raster designs transfers to the Client. Pre-existing templates, design methodologies, and foundational software logic remain the property of Lumin Oasis.

 

Source Files (Working Files): Project Agreements cover the delivery of flat, final export files (e.g., .JPEG, .PNG, .PDF). Native, multi-layered working source files (e.g., raw Adobe Illustrator .AI, .PSD, or .INDD files) are strictly proprietary to Lumin Oasis unless explicitly bought out as a separate contract item.

 

Third-Party Licensing: The Client is responsible for procuring any specialized commercial font licenses or stock imagery rights required for their unique business application.

 

Portfolio Rights: Lumin Oasis retains the irrevocable right to display all concepts, finalized graphics, and layouts within our professional design portfolio, case studies, and social media channels.

 

9. Printing & Vendor Disclaimers

Color Profiles: Lumin Oasis designs assets using professional industry standards (e.g., CMYK for print). However, because different printing vendors utilize varying inks, cardstock, and press equipment, Lumin Oasis does not guarantee exact physical color matches.

 

Third-Party Printers: Lumin Oasis is not liable for physical manufacturing errors, shipping delays, or material damage caused by third-party printing companies chosen by the Client.

 

10. Platform & Processing Fees

Marketing Platform Fee: If a client initiates contact or submits an inquiry through a third-party marketplace that charges Lumin Oasis on a per-lead basis (e.g., Thumbtack, Bark, Fash), a marketing platform fee may be appended to the project total. This fee is waived for projects with a total budget exceeding $700.

11. Confidentiality & Termination

Confidentiality: Both parties agree to safeguard all non-public business strategies, raw files, internal brand secrets, and sensitive communication shared throughout the duration of the contract.

 

Termination: Either party may terminate a Project Agreement at any time by issuing a formal written notice. Upon termination, the Client is legally required to pay for all design hours and completed milestones accrued up to the exact moment of cancellation, subject to the conditions in Section 3.

 

12. Limitation of Liability & Governing Law

Limitation of Liability: Our total structural liability for any design error, copyright conflict, or print malfunction is strictly capped at the total financial amount paid by the client for that specific project.

 

Modifications: Lumin Oasis reserves the right to adapt or modify these Terms at any time without prior notification.

 

Governing Law: This framework shall be governed by and construed in accordance with the laws of the City and County of Denver, Colorado.

Graphic Design Monthly Plans Terms of Service

By commissioning web design, web development, or online layout services from Lumin Oasis, you (the "Client") agree to be bound by the following Terms of Service. These Terms govern the creation, staging, and public deployment of your digital platforms.

 

1. Scope of Web Services

Development Framework: Lumin Oasis provides professional website design, custom UI/UX layout creation, platform configuration, and optimization services. The precise scope, including page counts, features, integrations (e.g., e-commerce, contact forms), and system requirements, will be detailed in a binding Web Project Agreement.

 

2. Client Assets, Content, & Copy

Content Provision: The Client must provide all textual content, copywriting, specific branding assets, imagery, and necessary credentials (domain access, hosting logins) within the timeframe established in the Project Agreement.

 

Legal Compliance of Content: The Client warrants that all materials provided to Lumin Oasis do not infringe upon any third-party copyrights or trademarks. Lumin Oasis is not liable for illegal or unverified content uploaded to the client’s site at the client’s request.

 

3. Cancellations & Refund Policy

Official Project Start Time: Upon securing access credentials and creative materials, Lumin Oasis will issue an onboarding email to the Client explicitly stating the scheduled development Project Start Time.

 

Eligible Cancellations: To receive a refund of any package payments made, cancellation requests must be submitted in writing at least 24 hours prior to the scheduled Project Start Time. Eligible cancellations will be refunded minus the non-refundable project deposit and a 7% development processing fee.

 

Late Cancellations & In-Progress Development: No refunds or cancellations will be honored within the 24-hour window leading up to the Project Start Time, nor will any refunds be issued for web development that is already in progress or completed.

4. Web Staging Locks & Final Deliverables

Staging Environment: During development, the website will be built on a private Lumin Oasis staging domain or locked development environment. This environment serves as the draft phase.

 

Launch Protocol & Access Removal: Full administrative ownership, native files, or site transfer to the client’s live domain will only occur once the final balance is paid in full. If a specific package restricts backend administrative access or retains a structural development footer, the Client may purchase full administrative handoff and removal of developer marks for a flat fee of $100.

 

5. Launch Timelines & Priority Development

Standard Milestones: Web projects move through sequential milestones (Wireframing, Design Approval, Development, Testing, Launch). Estimated timelines are provided upon project onboarding and are subject to client response times.

 

Urgent Requests (Priority Development Upgrade): If a client requires an accelerated launch timeline (e.g., tight product launch windows or last-minute site re-designs) that compresses our standard development sprint, and their package does not explicitly include Priority Development, they may add this service.

 

Priority Development fees start at $100 and scale upward depending on backend code complexity, third-party API integrations, and the severity of the timeline.

 

6. Revisions, Coding Adjustments, & Scope Creep

Structural Sign-Off: Once a visual layout concept (mockup) is approved by the client, development begins. Revisions requested after coding has commenced that alter the approved visual structure will be classified as "Scope Creep."

 

Overage Billing: Minor aesthetic modifications are covered under package allotments. Major structural alterations, custom plugin coding requests, or adding pages outside the original agreement will be billed as a contract amendment at our standard hourly development rate.

 

7. Hosting, Domains, & Third-Party Services

Financial Separation: The Client is directly responsible for procuring and maintaining their own web hosting accounts, domain names, SSL certificates, and professional email suites. These costs are completely independent of Lumin Oasis’s design fees.

8. Post-Launch Maintenance & Support Boundaries

Project Hand-off: Lumin Oasis’s operational and design obligations are considered fully fulfilled upon the successful public launch of the website or the delivery of access credentials.

 

Maintenance Allotments: Ongoing structural support, core updates, backup management, and security monitoring are not included in standard design packages. Unless the client signs a separate monthly Web Maintenance Agreement, the client assumes full responsibility for the technical health and updates of the site post-launch.

 

9. Technical Disclaimers & Browser Compatibility

Browser Standardization: Websites are optimized for modern, major desktop and mobile web browsers (e.g., current versions of Google Chrome, Apple Safari, Mozilla Firefox, and Microsoft Edge). Lumin Oasis does not guarantee legacy system compatibility.

 

Platform Redundancy: Lumin Oasis is not liable for site malfunctions, broken code, or platform downtime caused by third-party server updates, hosting outages, core CMS engine updates, or the client installing incompatible plugins post-launch.

 

10. Platform & Processing Fees

Marketing Platform Fee: If a client initiates contact or submits an inquiry through a third-party marketplace that charges Lumin Oasis on a per-lead basis (e.g., Thumbtack, Bark, Fash), a marketing platform fee may be appended to the project total. This fee is waived for projects with a total budget exceeding $700.

 

Online Payment Processing Fee: A 5% online transaction fee will be applied to the total remaining balance if the payment (excluding the initial project deposit) is processed online.

 

11. Termination & IP Transfer

Termination: Either party may terminate a Web Project Agreement via written notice. If a project is terminated mid-development, the Client is legally required to pay for all development milestones and hours logged up to the cancellation timestamp, subject to the conditions in Section 3.

 

IP Protection: No code, web layouts, or digital infrastructure assets will be transferred or deployed to live servers for a terminated project until all accrued development balances are fully paid.

 

12. Limitation of Liability & Governing Law

Limitation of Liability: In no event shall Lumin Oasis be liable for any lost business profits, security breaches, database hacks, data loss, or consequential damages arising from the operation or failure of the Client's website. Our maximum operational liability is strictly capped at the total amount paid by the client for the web design project.

 

Governing Law: This policy, and all web development agreements therewith, shall be governed by and construed in accordance with the laws of the City and County of Denver, Colorado.

Web Design Terms of Service

By commissioning web design, web development, or online layout services from Lumin Oasis, you (the "Client") agree to be bound by the following Terms of Service. These Terms govern the creation, staging, and public deployment of your digital platforms.


 

1. Scope of Web Services

Development Framework: Lumin Oasis provides professional website design, custom UI/UX layout creation, platform configuration, and optimization services. The precise scope, including page counts, features, integrations (e.g., e-commerce, contact forms), and system requirements, will be detailed in a binding Web Project Agreement.

 

2. Client Assets, Content, & Copy

Content Provision: The Client must provide all textual content, copywriting, specific branding assets, imagery, and necessary credentials (domain access, hosting logins) within the timeframe established in the Project Agreement.

 

Legal Compliance of Content: The Client warrants that all materials provided to Lumin Oasis do not infringe upon any third-party copyrights or trademarks. Lumin Oasis is not liable for illegal or unverified content uploaded to the client’s site at the client’s request.

 

3. Web Staging Locks & Final Deliverables

Staging Environment: During development, the website will be built on a private Lumin Oasis staging domain or locked development environment. This environment serves as the draft phase.

 

Launch Protocol & Access Removal: Full administrative ownership, native files, or site transfer to the client’s live domain will only occur once the final balance is paid in full. If a specific package restricts backend administrative access or retains a structural development footer, the Client may purchase full administrative handoff and removal of developer marks for a flat fee of $100.

 

4. Launch Timelines & Priority Development

Standard Milestones: Web projects move through sequential milestones (Wireframing, Design Approval, Development, Testing, Launch). Estimated timelines are provided upon project onboarding and are subject to client response times.

 

Urgent Requests (Priority Development Upgrade): If a client requires an accelerated launch timeline (e.g., tight product launch windows or last-minute site re-designs) that compresses our standard development sprint, and their package does not explicitly include Priority Development, they may add this service.

 

Priority Development fees start at $100 and scale upward depending on backend code complexity, third-party API integrations, and the severity of the timeline.

 

5. Revisions, Coding Adjustments, & Scope Creep

Structural Sign-Off: Once a visual layout concept (mockup) is approved by the client, development begins. Revisions requested after coding has commenced that alter the approved visual structure will be classified as "Scope Creep."

 

Overage Billing: Minor aesthetic modifications are covered under package allotments. Major structural alterations, custom plugin coding requests, or adding pages outside the original agreement will be billed as a contract amendment at our standard hourly development rate.

Financial Separation: The Client is directly responsible for procuring and maintaining their own web hosting accounts, domain names, SSL certificates, and professional email suites. These costs are completely independent of Lumin Oasis’s design fees.
